Here’s the complete text of the letter Speaker John A. Boehner sent Wednesday to House members, regarding his decision to initiate a lawsuit on behalf of the House against President Barack Obama over the administration’s use of executive actions.

For years Americans have watched with concern as President Barack Obama has declined to faithfully execute the laws of our country – ignoring some statutes completely, selectively enforcing others, and at times, creating laws of his own.

Article II, Section III of the Constitution of the United States dictates that the president, as head of the Executive Branch of our government, “shall take care that the laws be faithfully executed,” even if the president does not agree with the purpose of that law. Under the Constitution’s separation of powers principle, only the Legislative Branch has the power to legislate.

On one matter after another during his presidency, President Obama has circumvented the Congress through executive action, creating his own laws and excusing himself from executing statutes he is sworn to enforce – at times even boasting about his willingness to do it, as if daring the America people to stop him. On matters ranging from health care and energy to foreign policy and education, President Obama has repeatedly run an end-around on the American people and their elected legislators, straining the boundaries of the solemn oath he took on Inauguration Day.

Presidents have traditionally been granted a degree of latitude with respect to the enforcement of the law, and tension between the branches of our government is hardly new. But at various points in our history when the Executive Branch has attempted to claim for itself the ability to make law, the Legislative Branch has responded, and it is only through such responses that the balance of power envisioned by the Framers has been maintained.

President Obama’s aggressive unilateralism has significant implications for our system of government, and presents a clear challenge to our institution and its ability to effectively represent the people.

If the current president can selectively enforce, change or create laws as he chooses with impunity, without the involvement of the Legislative Branch, his successors will be able to do the same. This shifts the balance of power decisively and dangerously in favor of the presidency, giving the president king-like authority at the expense of the American people and their elected legislators.

It also has consequences for our economy and its ability to grow and create jobs. It’s

bad enough when Washington politicians force laws upon the people that make it difficult for private-sector employers to meet payrolls, invest in new initiatives and create jobs. It’s even worse when those same laws are arbitrarily enforced on the whims of the individual entrusted with the responsibility of carrying them out, adding uncertainty for private-sector job creators and families on top of the challenges they already face week-to-week.

Everywhere I go in America outside of Washington, D.C., I’m asked: when will the House stand up on behalf of the people to stop the encroachment of executive power under President Obama? We elected a president, Americans note; we didn’t elect a monarch or king.

Every Member of the People’s House took an oath to uphold and defend the Constitution. It is only through strong action by the House in response to provocative executive action by the Executive Branch in the past that the separation of powers intended by the Framers has been preserved. For the integrity of our laws and the sake of our country’s future, the House must act now.

I intend to bring to the floor in July legislation that would authorize the House of Representatives – through the House General Counsel and at the direction of the Bipartisan Legal Advisory Group (BLAG) – to file suit in the coming weeks in an effort to compel the president to follow his oath of office and faithfully execute the laws of our country. The legislation would follow regular order and be considered by the Rules Committee following its introduction, prior to its consideration by the full House.

Under our system of government, the Judicial Branch has the power to resolve disputes between the Executive and Legislative Branches. When there is a failure on the part of the president to faithfully execute the law, the House has the authority to challenge this failure in the Judicial Branch by filing suit in Federal Court in situations in which:

  • There is no one else who can challenge the president’s failure, and harm is being done to the general welfare and trust in faithful execution of our laws;
  • There is no legislative remedy; and
  • There is explicit House authorization for the lawsuit, through a vote authorizing the litigation against the president’s failure.

I believe the House must act as an institution to defend the constitutional principles at stake and to protect our system of government and our economy from continued executive abuse. The president has an obligation to faithfully execute the laws of our country. When this legislation is introduced in the coming weeks, I ask that you review it and join me in supporting it when it goes before the House.

    Of course, some may argue that some executive orders are different from other executive orders, just as some laws are different from other laws, and some presidential executive orders are justified or in keeping with the ideals of liberty and freedom while others merely abuse the action and the office.

    1. Which executive orders issued by presidents Reagan, George H.W. Bush, Nixon (RIH), Ford, Ike (RIP), and Dubya were “justified and/or in keeping with the ideals of liberty and freedom”?
    2. Which executive orders issued by presidents Clinton, Carter, Johnson, Kennedy (RIP), Truman (RIP), FDR (RIP), and Obama merely “abused the action and the office”?
    3. On what basis do you define “justified and/or in keeping with the ideals of liberty and freedom”? “Abused action and the office”?

      How about EKLJR, his ACA which did pass and become law and then he changed the law, all done prior to elections in the form of delays. He delays the employer mandate but not the individual mandate. He also exempted Federal Employees, Congress, and Unions all to his advantage. If a law is passed, Obama does NOT have the authority to change it, it stands as written. Obama also did that with the Dream Act for illegals when it was voted down by the Legislature. This is why we now have a southern border that leaks like a sieve. Obama and E. Holder has allowed the EPA and IRS to run riot on the American People. He turns a blind eye to these problems. Another fact is, I feel, this Administration cooking the numbers on Jobs. There are so many other things, but off the top of my head, can’t remember. It’s obvious that you EKLJR do NOT want to realize the lawlessness this administration. Try listening to some viable reports or postings of what he’s doing and become informed.

    1. Boehner doesn’t specify what court he will file in — Civil, I assume. So, we’re talking Judge Judy.
    2. He doesn’t specify ANY charges — obviously “using executive orders” is not a charge.
    3. The House better tell the American people how much this will cost. It may be cheaper just to vote to repeal Obamacare for a few more dozen times.

    Put up or shut up, Boehner. All you’re doing is baiting the most rabid of the right wing.

    I see the number of executive actions done by other presidents listed here in comments but what are they for? Did they help the American people as a whole are did they help only those it was written for? After watching President Obama pencil whip just about everything these days, I wonder just how much of it has really helped America? We are falling to the way side while he pencil whips another executive order signing another one that will cost everyone more money. (For those who do not know, pencil whip means signing off on your work without really doing it but saying you did.)

            Here in CA we are getting our full of ads on TV trying to make us all feel sorry for those that are illegals. And I understand that, so many children are born with illegal parents. But I see no reason that we pay all their bills when we have homeless and those that can’t find work but are trying, can’t get a little hand up.             His father was a Kenyan and by that fact he is also a Kenyan, Him and his mother moved to Indonesia and gave up their citizenship when they did so because Indonesia doesn’t allow dual citizenship. He never reclaimed his when he came back as he applied and attended college as a foreign student for which he had a grant, ones that citizens aren’t allowed to get. His SSn is for a man that died in Hawaii, who was from Connecticut, that is about as fraudulent as you can get and has been proven many times over.

            Excuse me, but the President does NOT have the power to change any law. The Supreme Court ruled that Obama Care is law. He does NOT have the right to change its provisions which he continues to do without amendments to the law being passed in congress. He does NOT have the right to change the legal mandates in the law. The Courts have NOT decided everything he is doing is legal or Boehner would not be forced to call for a lawsuit. What the president is doing with Obama Care alone are impeachable offenses. It is horrifying to me that Boehner must sue the President, rather than impeach him, because the democrats won’t vote to impeach a president who is NOT obeying his own oath. Do you honestly think Richard Nixon would have gotten away with the destruction of documents at the IRS? Is this president responsible for nothing in your eyes? So, the country isn’t falling apart? Honoring an oath to protect any idiots rights to blabber any non-sense he wanted. I swore to give my life in that protection. Isn’t it amazing that only a little over a million men and women take that oath while the remaining 289 million benefit from their daily sacrifices. When I served, my family was far below the national poverty level. We didn’t get any public assistance; and, I would not take any because I wasn’t trying to rip-off anyone. I wanted to serve. He has been asked NOT to use the Hillary word because it brings up memories of a terrible secretary of state with the deaths of department bureaucrats and good non-political marines. Better to read a variety of different sources to find the truth. FACT: He ordered that deportations be suspended and that includes anyone who sets “feet dry”. The result is a statistical drop in the number of deportations. You went beyond that by assuming that meant there were fewer illegals coming across the border. Obama is a double talking piece of garbage. It is impossible to be talking about amnesty in one sentence and increase deportations in the next.

            Obama has been taught to hate America (Muslim background). Rev Wright’s teachings are identical to the Muslim extremeists. He is a friend of Ayers – who followed the Muslim faith because it preached America was the great satan. There is no time in his life where he has shown any other core beliefs that directly oppose these known actions. His wife stated, and I’ll paraphrase here. “For the first time I don’t hate America”. Said on the night of his nomination. So we have a couple who interact on a daily basis. Spend taxpayers money to go on vacations constantly. And, has shown no compassion or empathy with the people that elected him. He is out to create as much damage as he possibly can. And, we still have people out there that think they are better off with him. All his actions have placed more Americans into poverty than ever before including the Depression. He still taxes even the poorest of us through increased costs for doing business in this country. Those additional costs are passed right down to each consumer. No real increase in production, transportation, or distribution just more taxes on each part of chain that places a slice of bread into a child’s hand. Believe me we will be paying for a very long time after Obama is gone. And, your children will ask why we didn’t get rid of him sooner. I going to say “Ignorance” and “Stupidity”.

            It is interesting that you mention impeachment. I actually have an issue with those on both sides of the political isle who ask this because they don’t seem to understand what it is and what it implies. Articles of impeachment are indeed filed in the House of Representatives, but the decision to remove the president requires a 2/3 vote of the Senate. With the current make-up of the Senate, the chances of that are pretty much nil. Are there some Democrats who would vote for it? Yes. Are there enough to reach 67 votes, assuming that all Republicans would vote to remove him (which I doubt)? No. Therefore, impeachment at this point is most likely a political nightmare and a colossal waste of time. It is probably going to be far more feasible in the next Congress.

      Yeah government bureaucrats should hold approval power over presidential nominations. There should be a fair and open primary process BEFORE the primaries. A “Primary primary” if you will. And it should be run and overseen by an agency of congressional appointees to make sure everything is done fairly, openly, and with the best interests of the people in mind. The records of this vetting should be delivered to Fox News to be piped in pure, unadulterated form to We the People, and then, and only then, should we allow a foreigner to become a veterinarian.

    What is missing in the discussion is that President Obama does not have to go through the process requiring compromise and review when he alters or refuses to prosecute laws passed by congress by fiat. We have a division of power in our government so that we the people can be represented by duly elected representatives in Congress. They are held responsible by the next election. President Obama by fiat by passes the safe guards set up constitutionally to allow one part of the government to act without review.

    I wish to point out a few facts. The number of executive orders is misleading. Except for Nixon all of the numbers are for two terms or more. However the number for Obama are for only one term. I agree that a lawsuit will do nothing to stop his violations. The only thing is to go for impeachment. He has made numerous treasonous statement in his speeches (Starting with his one in Ciro where he states the US is weak and ready for take over and etc in other speeches). He is violation of the oath he took to protect the country” border from all foreign invasions. Our Southern border sure fits into this violation. (treason in my eyes) IMPEACH HIM!!!!

    What will be the results if he wins the lawsuit? Does this allow him to revoke some executive orders or does it only allow less ink? Personally I say go for impeachment. Lies and deceit and not following the Constitution should be enough grounds for impeachment. There is enough film footage of speeches that prove the lies and changing Obama Care 20 sometimes on his own was not following the Constitution. I’m not going to mention the the stuff that doesn’t have even a SMIDGEN of CORRUPTION involved.

Somewhere, I read today the opinion that Obama decided he could not accomplish his wishes to “fundamentally” change the United States forever, given the demographics of the citizens and illegal aliens living here when he took office. Therefore, he decided he needed to radically change the demographics. So late last year he signed an executive order that children would not be turned away by border guards. Hence, the modern day “Childrens’ Crusade” to get across our border all the way from Central America.

      It’s going to take years for those children to grow up and become voting citizens (if they are allowed to stay here) and have any demographic effect on voting. Polls show that 50% of previous Hispanic immigrants want them sent back to their home countries. Is Obama planning to ignore the Constitution to the point where he proclaims himself “President for Life” and cancels elections?

    See, when you file suit against someone you need a specific, or at least a definable violation of the law. What’s Boehner’s violation here? That Obama didn’t “follow his oath of office and faithfully execute the laws of our country”.

    That’s like taking someone to court for “breaking the law” without defining that law breaking.

That’s a bunch of people, who we didn’t elect, making all these crazy new rules that act as laws! Obama needs a good legal choke chain put on him and his administration.     Speaker Beoehner is on the right track here. There is an old legal procedure, rarely used but still available, called the Writ of Mandamus, which can be used to compel the Executive to follow the law. In this case, the suit for Writ of Mandamus would be in the Supreme Court. I am not sure whether Boehner is using the format of Mandamus, but if he did he would set a very useful precedent that could be used by Congress, and potentially also by states’ Attorney Generals.

    I don’t think Boehner’s lawsuit will help at all. The legal system has always been reluctant to step into a quarrel between the President and the Congress. Impeachment is what is needed, followed by the Senate voting to throw the bum out of office. Otherwise, future Presidents will look at the precedent set by Obama and will figure it’s OK for them to be just as lawless as Obama, and to ignore the Constitution just as much.

    It’s time to get over the fear of Impeachment against the first black President. There are other able and patriotic black men who are far more qualified to be President than Barack Obama. Dr. Ben Carson, and former Rep. Allen West, to name two whom I admire greatly.
