Waiting for a Court Decision on Health Insurance Subsidies

Legal experts are mulling the implications of the ongoing delay in the release of an appeals court panel decision on the next legal challenge to the health care overhaul law. Court watchers will be hitting the refresh key on the website for the U.S. Court of Appeals for the D.C. Circuit each morning this week, looking for a decision on Halbig v. Burwell.
The case addresses a challenge to the legislative text of the 2010 health coverage law that appears to limit insurance subsidies only to states that have formally established an insurance exchange. CQ HealthBeat’s John Reichard noted on Wednesday that while the delay has prompted speculation about the decision, the challenge is a long shot to succeed.
A ruling against the Obama administration will likely be appealed to the full appeals court, prior to any possible acceptance by the Supreme Court.
