Heller Will Provide 60th Vote for ENDA, but House Action Is Unlikely (Updated)

Updated 11:49 a.m. | Sen. Dean Heller announced Monday morning that he supports the Employment Non-Discrimination Act, meaning that the lesbian, gay, bisexual and transgender civil rights measure is all but certain to have the 60 votes needed to thwart a filibuster.

“After listening to Nevadans concerns about this issue from a variety of viewpoints and after numerous conversations with my colleagues, I feel that supporting this legislation is the right thing to do,” Heller said in a statement.

The Senate is set to take a test vote on the legislation on Monday evening.

The Nevada Republican highlighted the existence of a similar law on the books in his home state.

“Under the leadership of this Governor, as well as the legislature over the past several years, Nevada has established a solid foundation of anti-discrimination laws,” Heller added. “This legislation raises the federal standards to match what we have come to expect in Nevada, which is that discrimination must not be tolerated under any circumstance.”

Heller’s senior Nevada colleague, Senate Majority Leader Harry Reid, had sounded optimistic in recent weeks about the chances for ENDA’s passage in the Senate.

A total of 21 states have laws similar to ENDA, which would block employment discrimination based on sexual orientation.

The measure already had 59 supporters before the Heller announcement, counting the GOP lawmakers who supported it at the committee level, so barring some change, the measure now has reached the magic number of 60.

Update 11:49 a.m.

The bill’s fate in the House has always been doubtful, and Speaker John A. Boehner, R-Ohio, made that more clear Monday morning.

“The Speaker believes this legislation will increase frivolous litigation and cost American jobs, especially small business jobs,” said Boehner spokesman Michael Steel.

A GOP aide noted that Boehner has long held the position that ENDA is bad legislation, and said the speaker believes gays and lesbians are already covered by existing employment law.


An earlier version of this story included the incorrect number to states with laws barring employment discrimination based on sexual orientation. The number is 21.

      Unfortunately, he isn’t up for re-election for another 5 years. He believes, probably correctly, that voters will forget by then. I’ve listened to him speak on several occasions, and he is a stereotypical RINO. One of the few things likable about him is that he does visit with his constituents far more often than Harry Reid, so at least there’s a fair chance to give him grief face-to-face.

    is a total outrage. Over 5% (and going way higher once the employee mandate
    kicks in) have lost their health insurance coverage, and they are brushed aside because they are “such a small group”, but gays, who comprise less than 3% of our population which includes all bisexuals, like our president and anyone who has ever even tried a homosexual relationship, will get “special rights” because there are so many, and they are deserving of special rights? Oh, that’s right, the president is in favor of this, but he isn’t in favor of giving other Americans their freedom to choose for themselves.

          PMM, evidently 60 senators (democrats and republicans) disagree that some people do not have the same rights as others. It will go up for a vote now. You throw out the word “dictator” but I don’t think you know what it means. This process described in the article that we are discussing is the best of a free and democratic America – 60 senators voted to end a filibuster and the bill can go onto a full vote. The House will get their say. If it gets to the president he can sign it or not. If he does, anyone with standing with the court can challenge it. This has nothing to do with a dictatorship.

          I’m sorry you hate the way our process works, but it is the best in the world.

      Unfortunately, he’s got Senator Harry “No” Reid, Senate Majority Leader,who will not take up any bill from The House that he hasn’t personally blessed, along with President “If you like your health care insurance, you can keep your health care insurance….just kidding!” Obama to contend with. Getting something done about growing jobs (unless they’re federal jobs, of course) is next to impossible until at least next year. The Keystone Pipeline project is popular on both sides of the aisle, but Obama keeps putting regulatory and bureaucratic hurdles up to prevent progress.
