Unemployment Benefits Extension Could Be Delayed Months, Even if Congress Acts Now (Updated)

Updated 4:49 p.m. | State unemployment officials are warning Senate leaders that the emergency unemployment benefits extension expected to come up for votes as soon as next week could face months of delays before checks go to the unemployed — perhaps even beyond the June 1 expiration date set in the bill.

The National Association of State Workforce Agencies warns that the retroactive legislation would be hard to implement, particularly while complying with new requirements — including means-testing so that million-dollar earners do not get checks — in the bill. Most states have warned it would take one to three months to implement the bill, the association said.

Some states may choose to opt out of the extension because of the administrative burden, the association said while warning that there could be a “large number” of overpayments due to the retroactive nature of the legislation.

Implementing the “work search” requirement in the bill retroactively would also be “virtually impossible,” the association said.

Speaker John A. Boehner of Ohio cited the letter in his own statement Wednesday, saying it showed the Senate bill was “simply unworkable” and failed to meet his test that it be fiscally responsible and help create more jobs.

But top Senate Republican sponsor of the bill, Sen. Dean Heller of Nevada, suggested the complaints were simply the latest “excuse” to deny benefits.

CQ quoted House and Senate GOP aides yesterday ($) questioning whether the retroactive proposal was simply unworkable.

Here’s the association’s full letter to Senate Majority Leader Harry Reid, D-Nev., and Minority Leader Mitch McConnell, R-Ky.:

The National Association of State Workforce Agencies (NASWA) has concerns with S. 2148, the Emergency Unemployment Compensation Extension Act of 2014. This legislation would temporarily reauthorize the Emergency Unemployment Compensation (EUC) program until June 1, 2014, but would substantially increase the administrative burden on states.

NASWA does not have a position on whether to extend the EUC program because our member states hold varying positions on that question. However, NASWA wants you to know states have significant concerns about the implementation of this legislation.

The requirements in S. 2148 would cause considerable delays in the implementation of the program and increased administrative issues and costs. Some states have indicated they might decide such changes are not feasible in the short time available, and therefore would consider not signing the U.S. Department of Labor’s agreement to operate the program.

A majority of states have said implementing the proposed legislation could take from one to three months. These delays would be due to a number of issues including:

1. Most states are struggling with antiquated and rigid computer systems — averaging 25 years old — thus making it very hard to implement program changes quickly and effectively.

2. The legislation is not clear on how states would pay for the administration of their EUC claims process if federal funds cannot be spent to determine an individual’s eligibility.

3. The “millionaire provision” would be very hard to administer. The UI system is not means-tested and therefore does not collect information on an individual’s adjusted gross income. Screening individuals by reported quarterly UI covered wages, rather than income tax information, would be a more feasible approach.

4. The backdating of EUC claims to December 29, 2013, would make it nearly impossible, in many cases, to apply a state’s weekly work search requirement, a key factor to determine eligibility for UI benefits and to avoid improper payments to claimants who are ineligible.

NASWA FACT SHEET

The National Association of State Workforce Agencies (NASWA) is concerned with S. 2148, Emergency Unemployment Compensation Extension Act of 2014 extending the Emergency Unemployment Compensation (EUC) program.

States indicate it could take from one to three months to implement the required elements in S. 2148. Last year, there were only 19 states able to implement the EUC FY 2013 sequestration benefit reductions within four weeks. Many states would not have the necessary changes to their State UI laws in place before the five-month EUC extension would expire.

The legislation would extend the EUC program to May 31, 2014, and would require states to backdate all EUC claims that would have been paid between December 29, 2013 and the date of enactment. NASWA’s concerns include:

Implementation: States would have to review each actual or potential claim, back to the week of December 29th. Some states would have to establish a manual process for paper applications and weekly claims since their computer systems are unable to handle such nuances.

Retroactive Weeks: When multiple weeks are paid at the same time, claimants who exhausted an EUC tier during that period would have to be redetermined and a new claim would have to be submitted for payment once new tiers are established. It would be very challenging to identify these claimants, and then administer the proper payments, due to the complexity of the review process and the potential volume of claims to review.

Overpayments: There may be a large number of EUC overpayments created by retroactively paying claims.

Tiers: Determining the correct EUC tier could be challenging as many states have seen their monthly total unemployment rate decline. This could lead to a State that would have been in Tier 3 through March having to undertake a complex reprogramming effort to have only Tier 1 and Tier 2 available in April and May.

State Law: States would not have the necessary conforming changes to their State UI laws in place before the five-month EUC extension would expire since many state legislatures cannot act quickly and some have already completed their sessions this year.

Work Search: Gaining appropriate information to manage the work search requirement for the retroactive period would be virtually impossible. Claimants would be asked to verify they searched for work when there was no requirement to do so. Even if claimants attested to the fact they looked for work, they would have to do that on a week to week basis and the states would have no ability to verify such claims. The legislation would have to release states from this requirement or the potential for improper payments would be enormous. Under current state law, claimants must verify they were able to work, available for work, and actively seeking work during that time period.

The legislation would require states to deny EUC benefits to individuals who attest to their adjusted gross income, but the attestations could be audited by USDOL and GAO. However, no Federal funds could be spent for determining an individual’s eligibility. NASWA’s concerns and questions include:

Information Gathering: States would have to create either a manual or automatic process to capture adjusted gross income information during the EUC initial claim process. If a formal certification method is required by USDOL, time delays would occur to properly implement the certification process.

IRS Database: This provision seems to suggest each claim would need to be cross-checked against the IRS database (which may or may not be available) or the state would have to obtain income tax returns from the claimants. The verification would take months to implement and cause extensive and costly programming.

Funding: States would find it very difficult to pay for this function from current UI administrative funding. Some states might decide not to implement the program due to lack of federal administrative funding.

The legislation would impact current information technology (IT) projects. This legislation is emerging at a time when states already have a very full schedule of IT projects for the permanent unemployment insurance program and as a result state IT staffs are committed to this work. Reassigning IT staff could derail progress on such efforts and potentially increase improper payments.

Some states might decide not to enter into an agreement with USDOL to extend the EUC program in 2014 because of the implementation concerns listed above. A state’s relatively low total unemployment rate also might factor into the Governor’s decision.

You almost think that the @gop senate made this bill so cumbersome because they wanted to show support for the unemployed but the same time they knew it wouldn’t be workable. The GOP never wanted a law that helped the unemployed, they just wanted it to look that way.

See, such is viewed as “welfare” and making people lazy bums. Only the threat of an empty plate, and starvation gets people to take work. And that last bit was said in response to myself asking how people remain motivated to keep looking for work, unless paid to do so.

        I agree. The sad part is that there are more than 15 millions unemployed and only 4 million job openings. Even if EVERY job was filled, there would still be more than 10 million unemployed. Another egregious thing the GOP is doing is ending unemployment benefits for 200,000 veterans. GOP sends them to needless wars and then abandons them when they come home needing a job.

      I have lost all that I had. I am 59 yrs old and have nothing to show for my life left. I can’t even afford to go to the Dr. I have tried to find work and no one wants to hire a 59 yr. old woman. I guess we are too close to retirement and they don’t want to train and lose us in a few years.     This is ridiculous people with children that depend on there (euc) to live day to day are put in a position because the economy is terrible and jobs are limited cant support them. But the congress members are sitting in a position where there kids or love ones will never see a hardship yet they hold peoples livelihood in the palms of there hands. People that work thier whole lives and need help just to get back to a comfortable state unlike the people who never work but get assistance such as welfare and dssi are living better that people that contribute to bettering the economy….but yet this is the greatest country in the world but it wouldnt be great without the peopl they are now denying help too.

    In order to stimulate the economy, during George W. Bush’s presidency, the
    federal government sent out direct payments to all taxpayers three times (2001,
    2003 and 2008).

    The 2008 payments were
    between $300 and $1200 per household and cost more than $100 billion.

    More fun facts about
    the 2008 rebates:

    – No one demanded that
    they be paid for, or that there be corresponding cuts to other federal
    programs.

    – The program passed
    with overwhelming bipartisan support: 81 to 16 in the Senate, 380 to 34 in the
    House. There was no filibuster, and among the bill’s supporters were John
    Boehner and Greg Walden.

    – The total time from
    the bill’s introduction, through passage in both houses, to being signed by the
    President was 16 days..

    – The unemployment rate
    at the time of passage was 4.9%. (The current rate is 6.7%.)

    No one in 2008, so far
    as I can find, was called a “taker” or “lazy” or accused of
    wanting a “government handout” because they cashed their check.

This entire UNEMPLOYMENT situation is almost no different minus the fact it may not be a union but it may as well be because WE are the people that are being paid out BY CONTRACT of the US g’ment in FEDERAL LAW. Mind you the policy makers KNEW that they had to take care of a DEC 28TH deadline BEFORE November, they fumbled and allowed people to go without benefits during, on and around Christmas as well NEW YEARS. So you tell me something if you were one of the people who was claiming money, paid your last months worth of rent and food you wouldnt be upset for the g’ments responsibility into trying to help you when the program was enacted to help individuals in these situations? 3 months later you’re sucking on bread and water, no television, cell phone or nothing because you had no fault of losing your job which the benefits helped you pay for the necessities that you need, had, have and required to do the things you need to fill in an obligation to get another job.       Unfortunately, in case you were not aware, there is now something they passed in a particular clause in the NDAA which allows the Federal Gov. to indefinitely detain (imprison) any of us for no reason what-so-ever with no trial/no due process.     People will start doing whatever it takes to put food not only in their childrens mouths, but their own mouth as well. If it means selling drugs or robbing a store they will do it. All we ask for is temporary assistance to be able to feed our families, keep our homes and pay our bills. These are benefits that we are entitled to for contributing to society. They need to get off their a***** and think about how this is going to affect our future generation as well. Where do they think our kids will end up if we can’t even afford their education???

        Losing a job through no fault of their own, this means in language- being fired, laid off..if you quit you are not entitled to these benefits UNLESS you quit the workforce within reasonable bounds such as- You are a full time driver for a company, the truck you drive a head gasket fails..that work truck the company provides so you can do your job is out of commission for over a month and you are working part time hours, then you have a right to quit and file because the company is no longer providing you a set full time hours. You are quitting as to no fault of your own because the company is not providing you the hours of full time which you were gained employment for. These people are entitled to these claims to keep money in their pockets, an economy going, chance and time to get what they need done inbetween looking for a new job. Denying millions of people who are just trying to make ends meet is a meat grinder looking for disaster.

This does not only effect people who were receiving unemployment but also the single mothers who rely on the child support to made ends meet. Child support taken directly from unemployment benefits is no long an option. So until we are all in the state of poverty while our government sends aide to other countries the American people suffer.

    How can they say that it would be hard to find out if people have been looking for work since December in order to avoid overpayment? First of all if a person has no income coming in and they have to feed their families and keep a roof over their heads of course they are looking for work. That was a stupid statement. I have been looking for work and going on interviews for jobs that I’m totally qualified for, but have not gotten. The job market is selective, unpersonalized and prejudice. Applicants are a test question and general personality survey now. The GOP is not worried about the billions of dollars they are putting
    out for the false SSi and Welfare recipients. And everyone in this
    country can name at least 10 people they know who are defrauding those. And the GOP says that we are not getting the jobs because we are being
    made lazy by the money we are receiving from UI benefits that we earned.

    The GOP needs a wake up call. From now on voting should be a active thing not just marking somebody because you heard of their name. But we really need to look at who is running and their background and qualifications. Maybe we should make them take the questionaire and the personality test from now on. And we should stop voting (yes) on the little stuff that is making them rich.

        i don’t need a wake up call this article states the GOP. The senators who introduced this bill vote are Democrats. But the person who is trying to fight it is a Republican. UI benefits were taken out of my pay each and every pay period. For over 22 years I should be able to count on that money when I need it. Period. If i decided to have baby after baby I could go to the government and say you owe me money, food, medical, education and housing and they would not bat an eye. Even though I have never paid into the system (taxes) that provided those luxuries. But the government has the audacity to say that the people who have paid into the very system that has funded this country can’t look to this country when they are in need.     I have posted this on other blogs, and I feel it needs to be said here as well…

    Once again another week goes by and nothing is done about eu insurance. More people have lost their homes, cars and ability to provide for their families. It is becoming more and more evident that our elected officials are more focused on political positioning than the people that elected them.

    They have lost sight of what their true job is, managing the tax revenues for the benefit of this country, not managing the funds to benefit themselves, their political party, or their self serving crony capitalism. Essentially, they are responsible for the health of our economy. They have failed miserably! It is their legislation (both sides of the isle) that has caused our economy to fail as badly as it has and yet they continue to turn their backs on the casualties they created.

    They have stated that, “we need to find a way to pay for this”. How about the 5 billion that you just sent to Syrian rebels, how about the 1 billion you just sent to the Ukraine ?!?! Why are Syrian rebels and Ukrainians more important than the citizens of your own country? How many Americans could have been helped with that money? How about the excessive amounts of government waste that could be cut to fund this? Give me one week with your budget and I could find hundreds of billions that could be used to infuse the economy and create jobs.

    I am beyond fed up with our current politicians. It is no longer “We the people for the people”, it has become “We the politicians for the lobbyist and/or the special interest groups”. I am tired of the excuses and finger pointing, I am tired of the failed/failing legislation , and I am tired of your self preserving political rhetoric. From this point forward I refuse to vote dem or republican ever again and I will encourage everyone who has been negativity affected by their decisions to do the same. Because any vote for dems or reps is nothing more than a self inflicted wound and self abuse. There are other options on the ballot that have become far better alternatives than the status quo. You have continually failed at the job you were elected to do, in any other industry you would have been fired long ago.

    I wish all these tight fisted tight sphinctered republicans would keel over with almost fatal heart attacks. I want them to survive, but miserably. Maybe a few could not recover. I’d be OK with lung cancer as an alternative. I’m in my 50’s, have been looking hard, There aren’t jobs and they go to the 20’s and 30 year old. You have to keep the car running, the phone connected and the internet working. I’ve been prioritizing keeping the life insurance because at some point in the not too distant future, if things don’t get better- well I’m worth more dead than alive, would to be able to leave something for my kid instead of asking if I can move in with him because I can’t afford to live on my own.

    Continued extensions of UI are turning the program into the new welfare. Studies are shown extending UI causes some people to delay taking a job. Contrary to all the sky is falling rhetoric, extended benefits have lapsed in the past and people got their act together and survived.     This is just ridiculous. I am so angry right now. Here we have Senate Democrats and Republicans working together to pass the unemployment extension benefits and John Boehner doesn’t want to take it up because of what some outside group says. The biggest lie the NASWA said was that, “Most states are struggling with antiquated and rigid computer systems — averaging 25
    years old — thus making it very hard to implement program changes
    quickly and effectively.” If that was the case, then why do most states now put unemployment payments on a debit card instead of a check? Obviously many states have updated within the last 10 years. There is one thing Senator Dean Heller is right about. This is just the latest excuse to deny benefits and Boehner’s just buying into it because he doesn’t give a damn about anyone but himself. At this point, I think the only thing that could save this bill is if John Boehner either a) go with the Senate on this one or b) step down as House Speaker before his re-election. I personally think he should go with b) because he’s clearly shown his true colors on this one. Even when people from his own party in the Senate are trying their hardest, he just shoots them down. He cannot be trusted.

    Please note that the latest obstruction is coming from the Labor Department themselves. It is them that created a thesis outlining why implementing such a program would not be feasible. The House Speaker and his colleagues are to blame for continuously filibustering the votes in the past, however a compromise was enacted only to have it questioned and/or possibly taken away because of those people Employed within “The National Association Of Workforce Agencies.” The Director of the Agency actually took the time to draft a novel objecting to the Extension. It is duly noted and I understand that issues may ensue. However, didn’t issues arise during the inception of the other extensions? How were they able to filter from those that are qualified to receive an extension from those that were not? I am quite sure they provided man power in order to isolate the ineligible from the eligible.

    One of the main reasons he object is that the majority of the Labor Departments are working with outdated computers. How is this possible? When I am quite sure the computers that he is calling primitive, have the capabilities to interpret which Americans are qualified for the initial State Regular Unemployment. If they didn’t how were they able to reach their determination. This same computer, computes an individual’s information as in employer information, salary, residence, and so forth to determine who is eligible. And if they hired people that have the intelligent mindset would know that if a query was ran on that same computer by utilizing Microsoft Access, then it would make it easier to determine the wealthy from the middle class if they isolated the information based on income.

    I believe he alluded to the non fact that there is no way of knowing a person adjusted gross income because the “UI system”do not have that capability . Well how, did they know my adjusted gross income as it was used to determine the Unemployment weekly amount. The system aggregates one’s income from the money earned from an employer for that calendar year, thus which gives the UI Department the amount we are entitled to collect.

    His complaints is just another excuse to derail this crisis. If it wasn’t for the unemployed he and his colleagues wouldn’t have a job. That is probably why he wants to prolong this issue.

    Wouldn’t have been wise, to have all of these so called issues resolved beforehand as the Labor Department had over 3 months to complete? What concerns me is that if “they” meaning the Department of Labor which I do not believe one bit, but if “they” were working with outdated computers that do not support the proper functionalities that is needed to isolate the wealthy from the middle class then why this computer issue wasn’t broached long ago. I am quite sure, there is an separate monetary account for anything relative to stationary, with that being said, those old computers could have been replaced long ago.

    Those excuses could be quickly resolved if they hired qualified workers in the first place. Are there 80 year old people working there that they are finding it difficult to perform such tasks?

    These people baffles me. It is disheartening to know, that since I am from New Jersey and worked in New Jersey, a state that withhold taxes from “employee” wages in order to fund unemployment insurance. I am unable to receive an extension on my own UI insurance. Because people keep getting in the way of the VOTE. My regular insurance ended in January 2014, so I didn’t have the chance to maneuver into an “extension”.

    It seems to me that this Director is working with Boehner and clan? What do you think? His issues are the same as Boehner, as both have an issue with retro payments amongst other things.

    Because of this Director and his colleagues many people if not already suffering will now start to loose their minds and that is not a good thing.

    They want to complain saying the new law if passed this week to reauthorize EUC would be difficult to adapt too is bullshit, the department of revenue and Department of Workforce Development work TOGETHER in each state! If they want to avoid paying benefits to eligible people that make a million or more a year all they have to do is look at past tax returns and tax statements filed with Department of Revenue for the year in question all done by a simple mouse click. I wish someone would seriously kill that John Boehner he is such a lier and the rest of his supporting republicans, I just cannot figure out why people voted for half of the congress officials we have, when is America going to wake up?

    this is crazy it not even going to be a 5 month extenion.my euc ran out on dec 29 2013 unemployment told me the max i can get is 63 weeks. so even when the extenions passes some people might only get 2 weeks some might get nothing some might get 5 months.i want to work but there no jobs in nyc right now

    Okay if its so difficult to implement ‘retroactively’… The SOLUTION is SIMPLE!!! Simply eliminate the ‘retroactive’ …VOTE TO RESTORE effectively immediately going forward to those long term unemployed who are eligible on the existing / most recent EUC Eligibility policy. THis is not complicated. People NEED HELP .there should always be an extension program available — but eventually benefits do run out. Claimants will eventually run out of weeks to claim. The language in this BILL to restore RETROACTIVELY IS COMPLICATING the ISSUE. Change the language Mr Reid!!

      Why should my retro-payments be scarified because these lazy assholes don’t want to do their jobs? I performed my required work searches – I earned the retro payment by hitting the pavement knocking on doors, attending job fairs, work-search related workshops and countless hours submitting resumes to online postings and filling online applications.         Hey Leeza, Don’t get me wrong , I to believe it can be implemented very easily. BUT …first of all I think we are all in agreement that this delay of restoring EUC has turned into a political game. Politics is about compromise, if a compromise is needed….. Coming away from a VOTE with SOMETHING vs. NOTHING. Is better. ?? Take a nice lump sum benefit payment now & many will just EXHAUST their weeks. So then what do they live on from now until end of June?? I’m just thinking for tghevbest interest overall is to go forward. It probably make more sense to the Republicans. it doesn’t make sense in the long term to implement a program that at this point will end in 2 months. would it not make sense to revise & 6 months going forward???? Anyone who has been in employed & paid taxes should be seeing a Tax Refund about now to help bridge gaps. ‘ just saying’

    My husband lost his job in August 2013 due to his disability from suffering a stroke 5 years ago. He applied for SS disability and was denied. He has never collected unemployment before. His unemployment ended on March 9, 2014. He collected for the 26 weeks only, no extension. My family has been forced to use retirement money to pay bills. Congress needs to make a decision!

    How is it difficult? The system is already in place. All they have to do is allow each recipient to go into the web site and certify for each of the weeks that have already passed. How is that any different from what they were doing the whole time? What a joke. I can’t believe this garbage. How did these people get elected in the first place?     New York State has been taking weekly claims electronically for the weeks in question dated back to Dec 29th. They already have our claims in the system and to be eligible for continued benefits you are asked to keep a log of all work searches. The work is already done! This is just a stall tactic by LAZY state workers who don’t want to do their jobs, and state angecies bitching about who gonna “pay” for all this extra work!!! Baahaaaa…I’ll play the violin for you – will that make you feel better about having a job!

How can he claim to be for fiscal responsibility when millions of our tax payers dollars are going to fund corporate welfare and foreign aid? When tax payers dollars were spent on bailing out the Banking and Airline industries, amongst other companies, where was their “fiscal responsibility” and budgetary concerns then?     Seems to me they are looking for every and any excuse to screw the unemployed over. Most states ask you to keep filing, even after your benefits ran out. I know that NY State does. There should be no delay in getting this out. It is NOT too difficult. It WILL NOT take too long. People need this help, and they need it now. Much more so than the Ukrainians who just got billions handed to them. Much more so than the doctors who need a bail out to keep their high 6-figure incomes. This is not a game people.     Thank You For Posting, very good read, but if you havent figured it out by now the government of our beloved country “Does Not Care” about its own people, beyond whatever taxes they can suck off you. Ive put a stop to that myself. I maxed out my credit cards for cash, and will not repay, let them get it from the Repubs. Also anything i buy besides groceries is online out of state, so i pay no state taxes, and i will, for the rest of my life work for cash, directly for some consumer that wants a deal (They All Do)
    and have no taxes removed from that, and claim no income, so the feds are done sucking off me, then turning their back when one of their loyal, vets need a hand. I have no pride to be an American, and recognize no Repub. as a human being.

    Im just thankful that at 63 years old and unemployed for the first time in 40 years, that i dont have much longer to put up with these idiots.

    OK so years ago I was on UK for three months after I got a job they said they overpaid me they took the money out of my state refund check so they are very capable of getting money back from those who shouldn’t get it and this las time I applied it took 9 weeks for them to send me a check so its OK when they have to send lump sum checks but now its to much work are u kidding me u call them and your on hold for over an hour then they are rude to you like your taking money out of their pockets how about giving me a job I’ll work for the state they have benefits and retirement everything is convienent when it works in their favor turn the tables and oh that’s gonna take more work or them doing their jobs that’s what they get paid for

    On the above line # 4 impossible to backlog. When unemployment ended in Dec 2013 their home page said that you should still file weekly to be edgible to recieve benefits if extended. I have been filing every week until the first quarter passed whereas it said I could no longer file because of insufficant wages. I have still been writing down all the info need in case of the extension passing. My point is if I was told to do it (and did) then why can’t the rest do it if they really needed it. I’m like many others cant pay bills and have amassed credit card debt just trying to make it till SS kicks in. I’ll be 62 in Nov. Noone wants to hire a 61 year old when they know that they can invest in a 25 year old for the long term. It’s impossible to find a job at my age. Believe me I have tried for now 2 years straight. I’m talking about any job. Anyway I hope it passes soon as things like this will ruin honest americans lives.
